Investigation into Olivier Bruneau death at an impasse, police say
Developer has refused to co-operate 'since the start,' lead investigator says

CBC/Radio-Canada has learned a police investigation into the 2016 death of an Ottawa man at a Preston Street work site is at an impasse because one of the companies involved in the case refuses to co-operate.

Olivier Bruneau, 24, was working at the bottom of a giant pit at 505 Preston St. in Ottawa when a chunk of ice broke away from a wall and fell on him. After his death in March 2016, two investigations were launched: one by the Ontario Ministry of Labour and another by Ottawa police.

The ministry completed its investigation and has laid charges under the Ontario Occupational Health and Safety Act of failing to take all reasonable measures to prevent the accident against the developer, Claridge Homes, sub-contractor Bellai Brothers Construction, and two supervisors.

But the police investigation is "pretty well at a stand-still," according to lead investigator Anthony Costantini. "Nobody is co-operating from Claridge Homes. It's been like that since the start."

A lawyer for Claridge Homes, Michael Edelson, did not respond to interview requests. Neither did Claridge's owners, Bill, Neil and Shawn Malhotra.

Right to remain silent

Gatineau criminal lawyer Sébastien Gagnon said people under police investigation have the right to remain silent.

"It's a fundamental right protected by the Charter [of Rights and Freedoms], that an individual under investigation isn't compelled to help the investigation against him," he told Radio-Canada in French.

"It's a choice. He can decide to give his version, but can also refuse, and we cannot hold it against him if he refuses to co-operate with police."

Otherwise, Gagnon said police have other means at their disposal, like seeking search warrants from a justice of the peace, if there are grounds to believe the company is in possession of evidence.

Gagnon points out, however, that a company has no right to stop employees from talking to police. "Let's take a fictional example, where workers witnessed a situation and their employer tells them that they will lose their job if they cooperate with police. That would constitute a criminal offense. It would be obstruction of justice."

To prove criminal negligence, police must not only demonstrate the employee's death was caused by a lack of safety measures, but that that company "acted so carelessly or with such reckless disregard for the safety of others as to deserve criminal punishment," according to a justice department document.

Westray law not enforced

Several lawyers and labour-law experts are following the police criminal investigation into Bruneau's death with interest.

It's seen as a test of the federal Westray law, adopted after the mine explosion in Nova Scotia that killed 26 miners.

This Criminal Code provision imposes on people who direct the work of others the legal duty to take reasonable steps to prevent harm to workers or the public. The violation of this duty can lead to significant penalties, including up to life imprisonment where death ensues.

However, since its passing in 2004, the Westray law has yielded little in the way of results. Police and Crown prosecutors rarely lay criminal negligence charges against companies. Many legal experts contend authorities aren't sure how to apply it.

On April 28, the National Day of Mourning for Workers Killed or Injured on the Job, the Trudeau government committed to better enforcing the Westray law.

Absolutely appalling Claridge.

But not surprising in the least.

I have also been following it with interest.

As an aside: The Westray Disaster is just mind-blowingly unjust.

Perhaps someone could pop by the site...sometime. I was going through Ottawa earlier yesterday....these are cell shots from the freeway:

Sweeet. I can see this area of Ottawa to be really quite nice. It has some nice urban bones around it....just needs some intensification. This project and the two others near it (Capital Hall, Nuovo) will sure bring more people, and support for local businesses.

It definitely is lacking lately, just like the market. The popularity of good new restaurants in virtually every neighborhood in the city means less people are heading to food destinations like Preston and the Market. Lansdowne is a huge drain on the rest of the city as well. Having more residents in Little Italy can only help the scene.

kwoldtimer...I mean that the area could use more people...and in turn that increased population base would help businesses around the area. It's great to see that this area is growing up.

The view from the Queensway is going to look so much different in a year or two. Capital Hall/Envie area already looks really tall and dense when viewed from the north...

I wonder though if it pushes out destination type businesses (Italian in this case) to attract more businesses aimed at condo dwellers (Shoppers, Starbucks, etc) This has happened to a lot of Toronto neighbourhoods.

I recently heard a rumour about this one. Purely rumour from someone who is working on a different project with a trade involved in the Icon project. The rumour is that construction is going to stop once they get to ground level and wait for more sales before it continues.

I have some trouble wrapping my head around the logic of this though so I'm not sure I believe it. I'd like to think it is BS.

Anyway, guess we will see. I figure if it does stop, it won't ever end up built as is planned now.

They are 33% sold as of March, but in real terms, they've sold 105 units and 10 of 12 penthouse suites. Pretty sure that is over 50 million in sales.

They built Tribeca east with well over 50% availability and it has now pretty much sold out so I would tend to think the same would happen with Icon.

That being said, they haven't updated availability since March which may mean sales are slow and they have all that litigation over that accident-I have no idea if that would have any bearing on construction or any requests to pull out of purchases.

My guess is at worst we may see a pause. I really want to see that building go up. It seems like we got a flurry of proposals for over 40 stories and this is the only one that is currently coming to fruition.

This project is moving forward with no plans to stop. Can't wait to see this project progress from ground level up.

Guy to the left of the cement bucket in yellow shirt... no hard hat! One would think the site safety would be stronger than that given past events. Ironic part is that Bellai is always bragging about their safety practices.
