Ha. Not at all. There were expansion/redevelopment plans for the site for a couple years now. Even some massing renderings floating around if I recall correctly.

I strongly disagree with you. SDAB failed to recognize problems with the permit and did nothing, and P & D issued the permit without any of the requirements it knew would cause problems for the development. The way the permits were issued was sneaky and designed to fly under the radar. I say there is collusion between City hall, P & D office and SDAB. I have direct experience with a similar project in which the SDAB failed to do their due dilligence as well. Formal complaints are being made.

^I will respectfully decline to comment as you need to review what powers planning/the DO has, what powers SDAB has and how they are both governed and by what. That will lead you to your answer.

I've been to this rodeo a few times Cold... seems you are the one who's unclear about the mandate and powers of the SDAB anyways.

Regardless, the system is broken, and I have to believe that, regardless of what best interest they beleive they are working towards, the Development office keeps making grave errors like the one in the article. Guaranteed that someone will end up paying for this one.

^ This has nothing to do with the MGA Cold, it has everything to do with the process not being followed and poor decisions being made. I know the P & D office loves to hide behind the MGA, but we do not buy the "just following the process" argument.

I hope that something changes, and that the way the system works now is corrected, starting with the failures at the D O's office, and the subsequent failures at the SDAB, as outlined in the article, and which has happened several times to my knowledge on similar type projects

Subdivision & Development Appeal Board

The Subdivision and Development Appeal Board (SDAB) hears appeals from people who have been affected by a decision of the Development Authority under the Zoning Bylaw and the Subdivision Authority under the Subdivision Authority Bylaw. The board is appointed by City Council and consists of citizens living in the city of Edmonton.

The SDAB normally meets every Thursday in the Churchill Building. If required, the Board may set additional dates for hearings.

Once you have met requirements and filed a proper appeal, this Board presides over your hearing.

Agendas listing appeals and hearing times scheduled for that day are posted in the hearing waiting area. Hearings do not start before the time listed on the schedule.

Sounds to me like 240 would make a good member of the SDAB.
I would suggest going to the Canlii site and actually reading the decision of the Court of Appeal; and reading the decision of the SDAB to get an understanding of the actual facts before making implications.

^^ Definitely not disputing that information. All I am saying is that something has definitely gone awry on the project that I posted the article about. I've been following this one and updating Rob Stack through info obtained through my resources since the foundation permit first came out in 2009. I don't disagree that there is a process that needs to be followed, But i reiterate that somewhere in the process something went wrong, that's been now proven by the courts.... and it is not the first time this has happened.
