Also, yesterday ChicagoShawn and I spoke with the doorman and found out that the garage and it's air rights were offered to the condo association first shortly after the building was converted as well as the retail component of the building. They decided that they didn't want any of it, so they don't really have a leg to stand on in opposing this tower. I actually can't believe how dumb they were. If they would've at least gotten the retail portion it could've subsidized and reduced their association fees.

I find it hard to believe that the air rights were just offered to them. Perhaps they had a right to purchase it and didn't exercise it. Or perhaps they had them and then the developer sold them, but they wouldn't just offer, out of the blue (so to speak) valuable air rights to a condo board.
If they did just turn down the air rights, this is the dumbest condo board of all time. If I live in River City, I call my lawyer and see if I can sue the board for damages.
