On a serious note, this being actually more of a possibility than one would think, and since they would legally be treated as two separate buildings, I don't know how they are getting around the required fire code regulated clear space above the top of the old walkup. Every abutting cantilevered structures I've seen have what looks like at least 20 feet of clearance between the old roof and the new underside of the cantilever. This would be full encapsulation.
