Not exactly. It's why most channel's now have watermark logos in the lower right corner of their programs. If the majority of an image is of another's work that is copyright infringement. A picture of the room with the TV, and discovery channel on, would not be. If Discovery Channel really cared to; they would have a VERY strong case to have Carlos's images removed as they don't fall into fair public use like satire or the work being older than 70s old.
I'm sure they're fine; worst case all they could do is a cease and desist. They wouldn't win a suit for loss of income since he's not profiting of them.
