It is very confusing. The developer wants 10 storeys. The tomato lady wants 6 storeys. The city council has approved rezoning for a 6-10 storey building.
What does this mean. You may be right in that if no accommodation can be made, then the developer is free to proceed with a 10 storey building, but, it appears to throw the tomato lady a bone, and, I suspect things may drag out, perhaps to the point that construction might not occur this season.
I think it would have been better just to allow the rezoning to accommodate a 10 storey building PERIOD. No ambiguity. No confusion. No false hope for the tomato lady.............
