Yep - the rails are grounded - intentionally and otherwise, by the inherent nature of where they are and how they are laid. Even the provision for fixed-block occupancy detection (the operational backup for CBTC) takes this into consideration, and is inherent in the design of the system. Tracks get grounded because they are on the ground. So.... no / lo voltage. Even a GFCI situation is designed for - the high voltage is drained off asap, and the power supply is cut as soon as the drain is detected.
The only risk is from third-rail power systems, like Montreal Metro, in which the third rail is highly insulated from the ground at every fix and mount. And it costs a lot in both installation and maintenance to keep it so. That is why OCS is considerably cheaper and easier, by comparison.
