Regardless of runoff any exposed soil not under active use must be seeded and strawed. Just looking at the pic shown, I would say it is clear much of the lot should be grassed at the moment. I’ve had inspectors site 0.1 acre lots for possible violations of runoff at the top of the lots that had a 9% grade slope with no possible way water would flow uphill. Was completely illogical but they were right under the law. This site definitely fails even without knowing their exact plan under bare minimum standards required.

This poor fella does have a small amount of knowledge from his 21 years in the field and a graduate degree to boot. Lol!

Your first sentence is what I was angling for. They may claim it is "active use" and that they are simply delayed due to weather.

They have updated the rules since I was last certified in 2013, but I think the rule was any exposed land not in use for 30 days had to be covered by vegetation. Even if part of the lot is under construction, those that aren’t must be seeded. You can see this on all active construction sites where there is new green grass always growing at the perimeter or even parts that have been graded but won’t be used for a month or two.

Someone please correct me on the exact rule but this whole site being exposed as is would not meet criteria. Even if it was under active use, there are parts that would still need protection such as around the perimeter and I see no protection for runoff prevention or even into any construction retention pond onsite. As stated, given the size and lack of activity covering the entire lot there is no way it is in compliance. They could already be sited for all we know.

Do we know if there is any active permit for anything activity at the site? One way to give the impression you're under construction would be to put fencing around the lot and make it appear as if its ready for construction, but not actually pay for the construction permit, and avoid inspections.... From the looks of the site they should have a land disturbance permit. I wonder if one was issued, is it still open? Because as much as its a shame how they've allowed the lot to get into this state - it would be even more of a concern that a site with an active permit of any type was allowed to get to this state without any inspection, notice, fine....

Even if not an active permit they could be fined and found in violation by the state. A few years back the state had gotten very strict with these types of issues because of the Supreme Court cases with AL and FL over water rights. It was a focus on every site and inspectors would visit randomly. It seems that has lightened up in some counties the past couple years including Fulton but it’s still not something Olympia would want to ignore. Once the state targets a site or company it can get ugly quickly and be a never ending battle. The fines can pile up quickly and can even lead to court filings. I’d say this project is DEAD for sure unless another equity partner appears very soon as in last week lol!

As someone else said, the type of clientele being sought wouldn’t even walk in the sales center with the way the fencing and site appears today.

They had been taking significant deposits from interested buyers for some time now, wonder how much of that money is gone from their burn rate of the past two years.

If I was one of those who put a deposit down, I would be very, very concerned at this point to say the least.

At the end of last year they said they were starting construction early 2019. This is an opinion, but Jan/Feb qualify as early 2019. March 1 is the official day of death for (n)Opus to me.

Sad, was excited when it was announced but maybe just too ambitious. Working in hotels, I was more excited when it was going to have a luxury component attached as I feel Midtown is such a great spot to put a Park Hyatt or comparable brand.

Lots of things are suppose to start in Atlanta but are always pushed back. PCM was suppose to open like 2 or 3 years prior. Let's take a second before we pronounce this EVIVA'd

This was originally announced 2/5/2014 in the AJC by Olympia. If that doesn’t qualify as DEAD or EVIVA’d I don’t know what does. Five years in development and we have what looks like an abandoned site basically?

I see the sale center open sign on the sidewalk when I've walked by and the lights are still on there at night so who knows.

I've always been a proponent of Opus. I'd hate for Librarian to be right about this one after calling him out on it several months ago when they allegedly started construction.

I went in with my girlfriend a year or so ago to take a look, the sales person was very rude and tried to shoo us out even though we had an appointment. Keep in mind we are well dressed folks rolling up in a new model BMW M6. They deserve to fail with their poor attitudes and lack of professionalism in sales.

That's an ambitious timeline, considering they haven't even filed for a building permit yet.

Some movement on 903 Peachtree. They filed today for a planning permit to combine lots.

On Monday 99 West Paces Ferry filed their land development building permit. 12 stories with 312 units and 5,900sqft retail.

Also the Otis Building in Castleberry Hill filed a land development building permit. This may not seem exciting, but I think it's one of the best examples of infill we've seen in Atlanta. Take a look at the current streetview on Google. This slots in perfectly between two existing people-scaled buildings, and it's built right to the lot line on each side.
