You cannot stand on the top of the spire (unless you balance on a beam). The top of the spire is not enclosed; there is no roof at the top of the lantern ('spire').
And 'roof', for purposes of assigning heights, is defined by the organizations that do the measuring, not by some fanciful acrobatics. At any rate, the top of a ladder or flight of stairs is clearly not a roof.
