In fact, if you look over the RFP you'll notice that nearly all the "requirements" were listed in terms of "preference" or "will prioritize." Don't see many absolutes.
Even if what you say is technically true, I still don't think it's very ethical to lead people on about stuff that's encouraged or important and then completely disregard them when decision time comes.
