The Registry of Deeds website states :

" Who Needs to Register?
Law requires all businesses operating in Nova Scotia to register with the Registry of Joint Stock Companies except:
New Brunswick corporations and NB partnerships/business names registered in New Brunswick
Individuals or partners using only their personal names without a descriptive element or attachment such as 'and Associates'
Partnerships whose sole purpose is farming or fishing.............. etc "

Civil tech is required to register. Or any other person could go down and ask to register a company with the same name and would be refused until Mr Nikkah had been told to complywith the law or face losing the name.
The only development failure in the last 35 years in Dartmouth have been no development.

Colin has a lot of experience on the topics that he speaks of. He researches the topics and includes facts and data in his posts.

You may not agree with his opinions and interpretations but that is no reason for a personal attack. Your post is unacceptable.

I think that if you can not deal with having a difference in opinion with somebody on a messageboard, it's time to go away until you mature enough to be able to have a civil conversation.

Agreed - we all get into disputes and arguments, but that's a bit much. Certainly King's Wharf has turned up the volume for how Downtown Dartmouth Businesses are feeling - when I was home in March I made a point of talking to several business owners when I was on the Dartmouth side and they all seemed quite upbeat!

Glad to see those comments have been dealt with.
Things are quite upbeat in the DDT. Nectar is closing (not my cup of tea) and Brooklyn warehouse is coming over. There is a new 'pie shop' open, lots of neat little shops. If we could get rid of the pawnshop, biker clubhouse, and tattoo parlours, I'd be very happy.

Those 3 dive bars at the bottom of Portland are no help to the neighborhood.

I have posted the details of Deed Transfer Tax revenues on my earlier post re the HRM deficit.
Any suggestions re the appropriate thread for HRM financial data and HRM monthly property sales data will be appreciated.
Ditto for suitable freeware to post such data in graph form - a picture is worth a thousand words etc.

You are quite right that persons doing business in Nova Scotia are required to register; however, failing to renew on time does not dissolve the corporation. That is a separate legal action which would be taken only with evidence that the company has ceased to do business or is otherwise operating illegally. It is true that many persons do not keep their registrations up-to-date but the RJSC does not have the resources to pursue them all and, when they do, the typical consequence is simply the payment of outstanding fees.

An expired or revoked business registration does not in any way dissolve the corporation or prevent it from carrying on business in Nova Scotia.

I agree.
If registration is not renewed there are other consequences. I believe WCB requires registration. O & D liability insurance is a big one. The ability to initiate a civil action. The bank would be upset if you failed to renew registration.
Would you enter into a business relationship with an unregistered entity ?
If I was about to enter into an agreement for construction of a building I would make sure all the legal requirements were in place as would by bank(ers) and insurers.

Civil Tech Construction Ltd renewed its registration on Wednesday June 24 2015, as shown on the website of the Registry of Joint Stocks.

They probably renewed before heading over to the job at Dutch Village Road. I assume that a building permit is not issued unless all regulatory requirements are up to date., which may be a big assumption when HRM is involved.

Wouldn't the permit have already been issued?

I don't think that all contractors are required to be listed on a building permit application. Drawings have to be submitted to the building department and then must be approved before a permit is issued. During construction, city inspectors make site visits to ensure that the construction is being conducted according to the building code.

In the HRM list of fees, I can only see a contractor name as being required for the "Streets and Services" section (i.e. sewer and water connection) - http://www.halifax.ca/building-renovating/documents/ConstructionPermits2015April28.pdf

I don't know how the process works but if we take a logical approach wouldn't we expect the entity issuing a building permit to have a lengthy list of questions regarding the companies involved in the construction of a project and the legal registration of all such entities. I assume the Building Code covers the essential elements of the whole process, note:
1.4.1.3. Required Information
2.1 2.1 Obligations of Owner

I only have one experience with the permit process in a municipality in Ontario. In that case, the general contractor employed a professional engineer to do all the drawings that were submitted to the municipality. However, the general contractor submitted the plans to the municipality and would have provided his contact information. So perhaps you are right.

As indicated in 1.4.1.3, it would depend on who is responsible for monitoring the work, whether it is a home owner doing the work himself, an engineering firm overseeing the work, or a general contractor who is overseeing the work. For many large construction projects, an engineering firm is employed and they are legally responsible for the work that is performed.
