Classic OMB — and blow on page 10:

"The test however, is [...] not whether an eight storeys development is appropriate."
then in the very next paragraph:
"The Board agrees that it [...] is a superior development to what an eight storey development would provide."

And even worse later on the Page:

"The Board also finds that the proposed development represents an appropriate response to provincial policies, which has as an objective to contain urban sprawl and encourage intensification where services and municipal infrastructure are already in place."
when the ruling has absolutely nothing to do with intensification:
"the property at 233 Armstrong and 3 Hamilton is permitted to develop with a Floor Space Index that is generally equivalent to an 8‐storey building without being subject to a maximum height limit of 8‐storeys (27 m)." i.e. they are permitted to build the exact same floorspace as prescribed in the CDP, therefore the same level of intensification.

This will likely arm Richcraft with enough ammunition to get their property at Bullman-Parkdale-Scott re-zoned well above the maximum prescribed in the Scott St CDP (the 45-degree angles give a cap of something like ~22-25 storeys, IIRC).

here's the latest on that CDP - Hearing scheduled for March 2015. Richcraft, TEGA, Homestead, and Archworks Design Management Inc (Barry Hobin)

Thanks! Surprised to see TEGA on the list, because I didn't think they owned any other property in the area, (111 Parkdale has long since been rezoned and sold to Brigil).

Also surprised, and disappointed, that Hobin is part of the appeal, I sat at the same table as him at the CDP workshop, and he didn't suggest anything at the table that wasn't included in the final plan. So what's his beef?

Richcraft's is obvi.

Do you know who Homestead is? Two quick Google searches turned up zilch.

Assuming this is the right company, they seem to be in the business of owning/operating rental properties: http://www.homestead.ca/

Homestead is a developer based in Kingston...they own rental buildings across the province (30+ in Ottawa) and also develop condos

Here's what I found when searching for Archworks https://opencorporates.com/companies/ca_qc/1169140101

That is the correct company. They own a series of 7 buildings in my parents neighbourhood in Kingston. They also own a few towers and other apartment blocks. And considering they do alot of rentals, they are actually quite nice and well maintained. For a rental company, I would rate them quite highly for quality and price.

Homestead's a good company. The worst press they ever got was when they tried to ban tenants from having Canadian flags draped over their balconies.

I don't blame them at all!!!

If you want a building to look like rifraf....just but flags in windows and balconies.

Real red neck IMO.

Well, thanks to the Conservatives, it's now illegal for landlords to prevent tenants from putting up Canadian flags on their balconies.

Developer wins OMB appeal for Hintonburg condo complex

By Jon Willing, Ottawa Sun
First posted: Thursday, December 04, 2014 04:38 PM EST | Updated: Thursday, December 04, 2014 04:41 PM EST

An appeal has paid off for a developer who has won the right to build a controversial condo tower in Hintonburg.

Ontario Municipal Board member Richard Makuch has ruled Tega Homes can build an 18-storey mixed-use complex on a block bordered by Armstrong St., Hamilton Ave., Spencer St. and Parkdale Ave.

A written decision says an 18-storey building would be a "superior development" compared to an eight-storey building, which is the current maximum height under zoning rules.

Tega originally wanted to build a 36-storey tower but later revised the blueprint.

It calls the project Attika.

Former councillor Katherine Hobbs convinced council to reject the development application in 2013 based on community concerns, even though the city's own planners supported it. Council knew turning it down would mean spending thousands on a consultant to fight Tega at the OMB.

Tega's lawyer predicted the company would win.

On Thursday, Mayor Jim Watson said council tries to collect the best information it thinks will be defendable at the OMB.

Watson predicts residents will see fewer land-use conflicts when council adopts a new zoning bylaw in early 2015.

"And if you do, I think you'll see us having greater success rate at the OMB because we'll have the backing of the official plan, the (community design plan) and the zoning bylaw," he said.

"The bottom line is the minute we allow something to go to the OMB we've lost complete control over it. Our objective should be to minimize anything going to the OMB because we have no ability to really effect change except to go and plead our case in front of the commissioner."

I have seen it all!!!Just can't believe it! Even Condo boards which represent the owners cannot enforce their own rules.

WOW...

And most egregiously, they are applying the 2014 Provincial Policy Statement to an application fromage 2013.

Usually applications are grandfathered based on the policies in place when they made their application, but the 2014 PPS has a provisions that applies it to in-stream applications at the time of the decision (including OMB decisions).

Weird. So it was measured against a standard that didn't exist when council decided to not approve it? I missed that when I went over the PPS.
