Hmm... I wonder if you guys will be insulting her appearance if she was FOR Canada Line and not suing it

I will agree that decreases in business income due to major infrastructure construction is unavoidable and no ground for a lawsuit.

Cambie merchant’s battle raises questions about justice

We’re taught in Canada that justice is blind, that all of us have a fair chance in the courts, which won’t discriminate for or against the rich or the poor.

It’s why the blindfolded goddess of justice — Themis — holds balanced scales in a prominent place in the main lobby of Vancouver’s courthouse.

But is justice blind for British Columbians seeking remedies in the civil courts? Or is it weighted in favour of the affluent?

Those are the troubling questions raised by Cambie Street businesswoman Susan Heyes’s continuing fight to survive the devastation of the Canada Line construction. They’re the same questions lawyer Peter Ritchie asked last winter when his clients — family members of a victim of the Queen of the North ferry sinking — settled their case because they didn't have enough money to go to court.

Heyes is the feisty maternity-wear designer, manufacturer and retailer, who took on TransLink and the public-private partnership that is building and will operate the rapid transit line from downtown to Richmond and the airport.

During the four-year construction disruption, Heyes’s business went from thriving to dying. She had a 20-year-plus unblemished record of paying her bills. But to keep her company alive, Heyes remortgaged her house twice and ran up credit card debts of $135,000.

She was certain it was the construction that was killing her business and others along Cambie Street, but she got no help from her neighbours. Many were too overwhelmed to fight; others were unwilling to bare themselves and their financial statements for all to see.

Her suggestion that they file a class-action suit fell on deaf ears until after her trial, when it appeared that she might win. Then, a class-action suit was filed and more legal games have begun. TransLink and the partners asked Supreme Court Justice Ian Pitfield to remove himself from the case. On Wednesday, Pitfield filed his written reasons for refusing.

In May, Pitfield decided that Canada Line construction had bled $600,000 away from Heyes’s company — less than the $900,000 she claimed and less than the mortgage on her home.

TransLink and its public-private partners were ordered to pay Heyes the damages and $138,000 in court costs, which don’t include her lawyer’s fees for preparing the case.

The companies paid the court costs but appealed, arguing that the legal “nuisance” the construction caused was justifiable because rapid transit is a public good.

They also argued on Wednesday in the B.C. Court of Appeal that that they shouldn’t have to pay the $600,000 until after the appeal was decided.

Why? Because the companies would suffer “irreparable harm” if they won the appeal and Heyes couldn’t return the money.

But $600,000 is chump change for them. Heyes’s lawyer, Cameron Ward, calculated that it is less than five one-thousandths of a per cent of the companies’ total assets of $13.2 billion.

Besides, the companies already saved $400 million by doing the more disruptive cut-and-cover construction. And the companies’ combined assets don’t take into account the combined treasuries of the federal, provincial and municipal governments.

Not only do they have a stake in the Canada Line, they have a huge stake in the case’s outcome. If Pitfield’s decision is upheld, it will affect how all public works projects are planned and carried out in the future.

It’s no secret that from the beginning, everybody involved with the Canada Line hoped that Heyes would just go away. Even now, it’s not a stretch to suggest that some would like to starve her out or frighten her away with requests such as suggesting that if they had to pay the court-ordered damages, Heyes should have to put up her house as security.

They asked for that even though the damages were awarded to her company.

Justice Edward Chiasson sided with Heyes, noting that without the $600,000, she might be bankrupt before the appeal went to trial.

Chiasson acknowledged the risk that even with the $600,000, Heyes might not be able to repay it if she loses the appeal. But the judge said he considered what would best serve justice and that was that Heyes deserves the fruits of her judgment.

Indeed she does. A scrappy underdog, she’s taken on the big corporations and is winning.

Still, she’s at risk of losing everything. How’s that for fairness?

The government recently introduced some measures aimed at countering that, but there’s no consensus on whether they’ll make it better or worse.

But we need the system to work at all levels — civil and criminal. We need to live up to that promise that justice is not only blind, but accessible to all.

The more you write, the less impressed I am with you as a person. How old are you, anyway?

As for the merits of the case, that's what the courts are for. I thought that someone with your political views, Mr. X, would admire her for the tenacity she has demonstrated in fighting to advance her economic self-interest.

Considering that her lawsuit could cost Translink and other public agencies potentially tens and tens and tens of millions of dollars (an extra bill that the public transportation agency does not need right now) if other businesses decide to file a lawsuit as well, the anger and rage is quite warranted. And the whole thing sets a dangerous precedent, costing us taxpayers hundreds and hundreds and hundreds of millions down the road with compensation packages for other capital infrastructure projects: things as simple as road paving, sewer maintenance, or even re-doing the sidewalk in front of your business...nevermind building a rapid transit rail line.

Her profit margins are a ridiculous load of bull.

i guess everyone should sue their municipality when major infrastructure projects take place. there unfortunately is always going to be some businesses that will suffer from a project this big. however, this cut and cover project was talked about for many years prior and was no big surprise. on the other hand i do some what understand her lawsuit against the two agencies for the loss of revenue, considering it was a crazy mess down on cambie for many years. humm, i stand in the middle i guess... although im totally pro transit!

To be fair, we should be angry with the idiot judge who made this decision. I'm still confident it will be overturned on appeal t the Bc Court of Appeal. And if not, there is a national interest which should allow an appeal to the Supreme Court of Canada - there's a long road to go before this is decided once and for all. Finally, a different judge might disagree and not follow this judgment.

I've seen this happen in other areas of law, where a judge ignored 30 years of common law and set a new precedent - only to have it overturned on appeal. So not all is lost yet.

This judgment is so clearly out of step with Canadian common law, that I can't see a higher Court upholding it. Besides, it will have the interest of the BC Attorney General, the Feds and every local government in Canada.

Agreed. These seem to be the same idiots letting murderers walk, giving the Hells Angels 1 day in jail, etc. Disgusting.

Sadly this lady's overpriced baby clothes are probably bought up by the truckload by the rest of the rich NIMBYs on the west side. It's win-win for them.

even if intransit wins, the optics of asking for the $600 K back would be horrible. IIRC, intransit is helping to fund her appeal, i don't kknow if this would affect it.

IMO the reason why evergreen is stalled is because of the pending appeal, if the govt still wants a p3 for evergreen.

I don't know if Evergreen is "stalled" per se. Analysis is happening over the summer and fall of 09, but there is still a $150m shortfall in funding IIRC.

^At the risk of sounding like DMJ, I'm kinda worried about translink's request for more funding. obviously nothing can happen (evergreen, bus/skytrain expansion, smartcards) until long term funding is established and BC (like everywhere) is short on cash.

i suppose we'll know in October. IMO this is another critical junction, just as passing the canada line was. It will take a political leap of faith to give translink what it needs to fund transit.

WRT evergreen, if they can drop the P3 to build the new Port Mann, they can do it with evergreen too..

now, if little ol' Heyes courts costs were $138,000, i would imagine the mighty giants of Translink and its partners would have legal fees and court costs around double to quadruple this amount.

those morons should of settled out of court long ago.

I hope all the tax branches (Revenue Canada, PST, etc.) review her stated earnings for a few years prior to construction to make sure it jives with what she says she's been losing and she hasn't been reporting less.

ok I dont want to take this thread of course but I am always absolutely disgusted with these comments(no offense). Our crime rate and violent crime rates has been declining for decades now and is at or around the all time low. All thanks to revamping our justice system to focus more on rehabilitation and prevention instead of punishment. Hell murders were I beleive at their highest right before we abolished the death penalty...see its allot more complicated than you make it out to be, and our courts have never been better, infact they still have allot more they can do...probably 90% of the criminals should never be locked up because either there are known and tryied methods of rehabilitation(we just need to invest more money in to it, though its cheaper in the long run then just locking them up) and b most crimes could be prevented through many measures and prompt medical and psychiatric treatment.
oh and maybe if I got your type of prison sentence instead of a divergence charge(not even a criminal record exists now) some community service, a huge fine and a very short stay in pretrial when i was younger I wouldn't be here typing this, contributing to society, very well also, and in my selfish opinion being a darn good citizen....believe me you would think i got a slpa on the wrist if you knew what im talking about.
