Lawsuit cites complaints at Sabine condo project downtown
CWS attorneys meeting Monday with residents to resolve issues

Residents of the Sabine on Fifth have sued the developer of the downtown Austin condominium project, CWS Capital Partners, alleging problems with the building and its elevators that they say pose safety hazards to the occupants. Additionally, Los Angeles-based CWS has not paid more than $150,000 in 2008 property taxes on the building, at Sabine at East Fifth streets, and has stopped marketing the project, though less than half of the 80 units have been sold. Officials from the Travis County Tax Collector/Assessor's office said they are prepared to take legal action as soon as next week to collect the overdue taxes.

The Sabine is a 10-story former office building that CWS converted into residential condominiums in 2007, with units priced from the mid-$190,000s to the mid-$500,000s. Last week, Austin attorney Zach Wolfe filed a lawsuit on behalf of 35 residents in state District Court in Travis County, listing numerous concerns that residents say have been ongoing for months. Wolfe is scheduled to meet Monday with a lawyer for CWS, and he said he is "very encouraged that they are serious about resolving the issues," based on preliminary talks with a lawyer for CWS.

One of the plaintiffs is Scott Dixon Smith, who said he is blind and has been stuck in the elevator several times. "In numerous meetings with CWS over the past six to eight months, the residents have grown tired of the lack of action," he said. "Our lawsuit certainly speaks for itself." Greg Miller, vice president of investments for CWS, said the complaints in the lawsuit "have either been resolved or are in the process of being resolved." Neither he nor the CWS lawyer would elaborate. Key among the complaints are "persistent and major problems" with the two elevators, which stall or go to the wrong floors, according to the lawsuit.

During a Dec. 29 inspection, Lawrence Taylor, the state's chief elevator inspector, found 19 code violations, according to his report. They included some "significant safety code issues" that "needed to be corrected without delay." In addition to the elevators, the lawsuit cites problems including leaks, improperly installed window seals and inadequate soundproofing.

In addition to the elevator and other issues, the lawsuit says CWS is delinquent on property taxes for more than 40 unsold units. Dusty Knight, chief deputy of the tax office, said that CWS owes $151,499.35 in property taxes on the Sabine. After recently sending CWS a delinquent notice, a demand letter and a notice of possible litigation, Knight said Friday that his office next week will be "moving toward litigation unless they pay or make arrangements to pay." Knight said the company was current on other Austin properties, including two apartment complexes on East Riverside Drive that it eventually plans to replace with new condominiums and apartments.

Because CWS still owns more than half of the Sabine's units, the lawsuit said the company still controls the condominium association. Residents won't get control until 75 percent of the units are sold. Urbanspace Realtors, which had been marketing the units, pulled out. "We did pull out of the marketing the remaining units because we share the same concerns as the residents," said Kevin Burns, owner of Urbanspace. "We hope that these issues get resolved, as we are believers in this project and its potential."

The lawsuit seeks remedies for a long list of complaints. While it is pending, residents are sending their monthly assessments to a court-supervised account. The elevator inspection was prompted by complaints from residents, said David Gonzales, a manager in the compliance division of the Texas Department of Licensing and Regulation. Taylor inspected the elevators in the company of Leo Willett, service manager for KONE Elevators and Escalators in San Antonio, which CWS had hired to service and maintain the elevators. Taylor's report noted that there had been no elevator inspection reports for the building filed with the department "for a number of years." Among the violations, Taylor said there was no evidence that required monthly tests of fire service were being performed. He also could not locate the required emergency evacuation procedures.

Gonzales said his division is conducting an ongoing investigation into the elevator issues. Once the investigation is completed, CWS will be required to address any deficiencies before receiving a certificate of compliance, Gonzales said. Meanwhile, he said Sabine's building management recently had an independent inspector conduct the required annual inspection. The building manager notified Gonzales' division that all violations have been addressed, although that has not yet been verified with a follow-up inspection, Gonzales said.

Doesn't someone here live in that building?

I looked at it briefly but I just can't justify a 50% mortgage increase without any SQ footage increase. Guess I'm glad I didn't do it.

Looks like the residents could be footing the bill for an elevator and a tax lien. Neither is cheap, especially if there are only 35 units to divide the cost between.

I live there. We are to keep mum about it while the lawsuit is ongoing. So don't ask! But the article is pretty good, and the lawsuit itself is public record, of course.

The residents are in no way responsible for the taxes on the units the developer owns. That's not at issue.

It's interesting that UrbanSpace is no longer marketing the units since they were so heavily involved in the project. Are the rest of the units still for sale in some capacity or is everything on hold at this point?

Happened to see this last night and it looks good. Anyone know if they are still planning to add that crown to the building still?

Not sure officially if they are putting the crown on.... but I would guess the "lipstick on a pig" move suggests they are not. ( sorry, I think it looks cheap)

I think that crane is the parking garage for the Baptist church!

Hilton eyes Austin for new Denizen hotel brand

Austin is in line for a Denizen Hotel, a newly announced lifestyle/boutique brand of Hilton Hotels Corp.

In addition to Austin, negotiations are under way for Denizen locations in Abu Dhabi; Beverly Hills, Calif.; Miami; Las Vegas; London; and Cancun and Los Cabos, Mexico, according to a release today from Hilton.

Nicola Piggott, senior Brand Communications manager for Hilton, declined to release additional details about a future Austin location, citing pending negotiations. She said there are “no specific details yet on locations/opening dates, although we expect that the first Denizen Hotel should be ready for guests by 2012.” She declined to say where the first hotel will be.

Randy McCaslin, a vice president with PKF Consulting in Houston, said he was not aware of a new Hilton brand coming to Austin. And with the credit crunch severely restricting capital for new development, “there is no financing available so if it is being planned it would be in the very early stages,” he said. “Nothing is going to get started until 2010 at the earliest.”

White Lodging Services Corp. has put a 1,000-room Marriott hotel planned for downtown Austin on hold.

This year is expected to be a challenging one for hotels amid the ongoing recession. PKF is forecasting Austin’s citywide hotel occupancy rate to decline 3 to 4 percentage points in 2009, although McCaslin recently said Austin’s strong local economy will position it to “recover quickly in 2010 as the national economy stabilizes.”

Hilton’s release said the Denizen brand will complement the company’s other luxury brands, including the Waldorf Astoria, Waldorf Astoria Collection and Conrad Hotels and Resorts. The Denizen concept marks a return to the vision of Conrad Hilton, the company’s founder, said Ross Klein, global head of Hilton’s luxury and lifestyle brands.

“The term denizen literally means ‘citizen of the world,’” Klein said in a statement. “We created this new brand in homage to guests who desire and deserve the best hotel experiences, both on an emotional and functional level.” Denizen is Hilton’s second new brand announcement this year. In January, Hilton announced a new extended stay brand, Home2Suites. Home2Suites will be based in Memphis, along with Hilton Garden Inn, Hampton Inn & Suites and Homewood Suites. Hilton’s other brands, including its luxury and lifestyle portfolio, will be based in the Washington, D.C. area.

Once they pour the 38th floor at the Austonian, it will be taller than the Ashton. It will also be roughly the same height as the 41st floor at the 360.

I can't imagine that they can add another floor without raising the crane. The concrete pump is about to hit the crane boom.

Judging by the fact that it's breaking the horizon line and the Ashton isn't, I'd say it's already taller.

The top floor is just forms now; I don't think they've poured any concrete yet. The safety railing on the forms is at the horizon, while the form is slightly below it.

Thanks for the pics. And I noticed that the floors 40 on up have higher celings than the lower floors. Am I right? That is from the renderings of the Austonian.
