Lawsuit would block zoning change

With more than $28 million spent on development and 200 units sold, the lawsuit asks the court to confirm Kargil's vested right to develop the property based on previous city approvals.
Since Fioretti proposed the ordinance three months ago, the developer has been unable to receive the funding necessary to carry the project forward and its efforts to sell units has been severely hindered, according to the lawsuit. "Prior to him filing the ordinance to downzone the property we were the fastest selling project in the South Loop," Giles said. "We have stayed at that level since that ordinance was filed, and we need that cloud lifted."
