Federales has appealed the Board of Adjustment's decision against them:

Although I was more inclined to support Federales than the neighborhood opposition, their choice of attorney has me rethinking that position.

Four Corners has quite the uphill battle. Phoenix is under no obligation to hand out variances and use permits. The applicant has many tenets they have to meet (page 3) for every line item which will not be easy for them.

They're probably hiring that Wilenchik hack because he's an anti-government troll that isn't afraid of losing. Any sane lawyer would have laughed the appeal out the door, probably like their original counsel did.

It seems strange to me that this is the development that Roosevelt is going to attack compared to the Apartments that went up at 3rd street.

I really don't get the opposition; it looks like a nice big patio that will feed into the street and the general area of nightlife/entertainment/Restaurants.

What is so bad about this restaurant? Its too big?

I believe it's basically being perceived as another Golden Margarita if I am reading the opposition correctly. I'm not sure if it's going to be quite like GM's was. I posted about Federales when I saw the permits were submitted last year some time and I was looking forward to trying it out when it was completed. But now, I am also having second thoughts with their choice of attorney. I believe the city did sign off on everything. So the fight is pretty much the Roosevelt area and not with the city.

The renderings alone tells me this is nothing like The Golden Margarita.

I actually met the owner of the golden Margarita, and he was exactly like you would expect, that was the result of space being available. This development and restaurant group is many steps above Golden margarita in every way.

I dont really have a dog in the fight just seems strange to prevent a pretty nice looking restaurant from opening on Roosevelt.

Yep. It doesn't "feel" like the RR they want. Same reason they would oppose a Cold Beers and Cheeseburgers.

Hiring Wilenchenk is a bizarre choice. Perhaps a few years ago but with his recent press that is going to sink them. There are dozens of zoning guys who would like the experience even if it's a tough case.

Maybe they don't deserve it if they are dumb enough to hire him.

Whether this is a "fit" in terms of culture, etc is subjective, the core of the variance and use permit process is that granting one should not have any adverse affects on neighboring properties. I don't see a rambunctious full patio bar as meeting that without precedent. This would be a better use for the areas of downtown that have that as I'm pretty sure all the existing patios in RR don't sell hard liquor. If this were off Van Buren or Washington St I doubt anyone would say anything.

Accordingly, the experienced zoning attorneys would know that the requirements of use permits and variances are very strict. They're not going to burn bridges with the City fighting an uphill battle because they need that productive relationship with the City to provide results to future clients. Like, I generally do not recall any board of adjustment case that's been appealed to Superior Court and if I were a zoning attorney I would not want to be the first in memory.

Wilenchik has no such skin in the game. This is just far-right grand standing and opportunism. I hope the judge laughs them out of the courtroom.. the last thing we need is Phoenix to be another ground zero in some out of towner's anti-government charade.

There are some storefronts on the east side of Van Buren in the ground floor of that garage. It might be one of those.

At a loss as well. The corner spot (next to Pizza Hut) is supposed to be some brunch spot called Plush PHX (former Even Stevens spot). On the 1st Ave side and next to Plush, I think it's Loaded Weiner (former Poke Spot). There was one spot left and I think there's some cigar/vape shop? No idea where it would go.

Excited for another brewery in downtown!

Great spot for it if that is indeed the case. I'll try to drive by the area at some point this weekend. Construction should be well under way if they plan to open by 9/15.

Phoenix Business Journal reports that Little Miss BBQ has canceled plans to open on Central in midtown due to rising interest rates and increased construction costs.

The absence of any visible progress over the course of a year made me think this wasn't going to happen.

On the other hand, Cornish Pasty Company on Monroe took five years but did eventually happen.

You're right. It would be a good spot for a Midtown CPC, but I expect it would open around 2030 given how long it took for them to renovate and open the downtown location.
