I'm not exactly sure how it works but where it is on the slope no part of the building is actually over 5 storeys though the total number of storeys is 9 from the very bottom floor on Water Street to the top floor on Duckworth.
Architype had on the
St. John's Project Threads main page that "the building proposal is 7+ stories at maximum cross section (approx. 19 meters), with a total of 9 levels on sloping ground." but the building was modified a few months ago as well. I'll see if he can explain it better because I'm just confusing myself now.
