Moving a HQ from a heavily taxed state to one in which is quite light on corporate taxations isn't very simple. In general, moving a HQ is not an easy task or a quick process.
California is going to fight too-and-nail on any move.
In any case - even if Tesla has decided to move its HQ to Texas, the process itself is going to take a while. So, Musk cannot really say anything at this point in time. He's obviously kept the door wide open for a move.
