Silverstein is pushing for a special permit to build more housing because his site was zoned primarily for commercial use. The 80 South St tower will be built as of right (which is why so much of the sale depended on the transfer of those air rights). But the city still has zoning guidelines, regardless of height, as far as design goes. That's why the Tower Verre had to jump through so many hoops. Whatever the design is here, it will most likely be something that won't require any special permits. They don't want to jump through any hoops, and risk anything.
The good news is that if SHoP is still on, they've shown they can do great within the zoning envelope.
