You're right, I hadn't noticed that until I looked at this photo once again, not sure what the reason would be for the two variations.

^ My only thought would be that the top rail is added after the bottom section is installed and some of the railings aren't complete.

ahh, yes, you are correct....some of the railings are shorter....

too bad, I kinda like the simplicity of the shorter version...
