All of these a great.




This is a gorgeous infill development, both the tower and base. I wonder why the city didn't make a decision?

One of the legal remedies I've seen in NJ and elsewhere is for planning board's that play politics in delaying a decision is that the development becomes automatically approved if the board fails to take action as required by law. No one wants that of course, but it creates a strong incentive for all parties to follow the rules. There is the occasional story of a planning board may delaying a decision on a mosque that is legally allowed to be built in a zone that allows places of worship. It reeks of discrimination and the courts have called it out. Other times it's affordable housing - where the development meets all the zoning standards and all that's needed is site plan approval.

With all the development going on in Toronto right now, it seems odd that this is the one where the city and/or planning board fails to make a decision within the statutory timeframes. What's the back story here?

The province gives the city 4 months to make a decision on an application then the developer has the ability to appeal it to planning court, which can choose to approve it without the city’s approval.

4 months is essentially an impossible timeline to meet for approvals. Absolutely no development gets council approval in that time.

Some developers just appeal as soon as they legally can as they figure it’s easier to get approvals in the courts than at council. Most don’t do that though, as it’s still typically slower and more expensive than council approval. Usually developers do it if the city planning department doesn’t approve of the application and is looking like they will be issuing a refusal recommendation to city council.

There are a dozen different “real” reasons a developer will appeal a project, but the technical legal reason is almost always “lack of decision”.

Not sure where else to post this but the condominium project that'll practically hug the Bay building at Yonge n Bloor to the north is going ahead soonish it seems....this is the 85 metre, 25 floor tower proposed by Menkes, now called Adiago:

Hi Julie. Not sure which pre-construction condo you are referencing (there are hundreds in the pipeline) as my last post featured under construction projects.

I'm sure there are other forum members better-equipped to comment on the pros and cons of buying pre-construction, but I would suggest that the time-line for many new projects to move through the city approval process to sales to construction (usually triggered by about 70% of firm sales) to occupancy and registration, has increased quite dramatically due to the 'avalanche' of new proposals (no doubt overwhelming city planners, construction suppliers etc.). While many predicted that the pandemic would stall pre-construction sales of residential units, the reverse seems to be true for 2020 and some are predicting an increase in pre-construction sales of 15% or more for 2021.

I guess it's not rocket science to suggest if you are looking for a 'move-in' condo for your parents in the next few years... you might check out some projects that are well-under construction already?
