Yeah to build some generic ikea-esque spandrel skyscraper box instead of actual craftsmanship..

lots of pictureframe jutouts and uneven windows - hey "artistic"... blegh.. can't even call this shit architecture anymore..

I'm in the Ontario Land Tribunal hearing for 41-46 Wilson St. & 97, 99 and 117 John Street N Hamilton.
There are now two appeals on this site - both are uniquely technical.

The lawyers are going to meet and come back to the OLT on October 26.
I'll write the story of the appeals over the weekend.

Is this for the second and third building, or is the first building now on hold as a result?

they have their excavation permit issued so that will be able to begin that at least, but excavation won't take long here as my understanding is the project is slab-on-grade with no basement level.

The question is when they'll be able to get their above grade permit, and what exactly is under appeal here. It may be something technical like parkland dedication fees or something which doesn't effect permit issuance.

This is disappointing to hear, I was under the impression that construction would begin any day now. I hope the City and Emblem can quickly figure out that outstanding issue, very curious what the hold up is.

I looked at the OLT appeal on the province's case status service:



Appealed under section 41(12.0.1) of the Planning Act, which says:



So it looks like the City imposed some condition on Emblem as a part of Site Plan approval which they didn't like. This may or may not impact construction timelines, however I don't anticipate that it would.

Noticed this tidbit on Emblem's recent Youtube recap (92 is the old Proctor building). Wonder if they also scooped up the Framing Warehouse site as well.

Interesting. I’m pretty sure they’ve already acquired the framing warehouse and the parking lot on Wilson next to the Proctor building. Wasn’t there a post about that earlier? Anyway, it’s hard to imagine how different this part of downtown will feel in a few years.

I suspect there are one of three possible situations:

1) The crane and such they need aren't ready, and our assumptions and any information we found about it starting were wrong.

2) There are unknown delays, such as the OLT situation, or other permitting or contractor delays.

3) The Hamilton market for condos has slowed, especially with so many new buildings on the market. Radio City was supposed to start months ago now, and is sitting there. The Royal Connaught... Well we all know about that, and then there's this and the condo beside West Harbour, all in a kind of sales are ongoing but there's no movement. Maybe waiting for interest rates to go down. As we see with the KiWi completion too, many brand new units are for sale, and people aren't buying those either, so those lower prices might be pushing pre-build prices down, plus Emblem may not want to compete with themselves on tower 2 and 3 which have yet to sell out and go on sale respectively.

All my speculation, but I'd be curious if others agree.

I suspect point #3 could be part of the problem. I'm noticing condo units staying on the market for longer periods of time throughout the city. I counted about 23 KiWi units that are still for sale on MLS - and from what I've seen, what's listed on MLS isn't usually everything they have for sale. They probably need to drop the price a bit now to attract buyers.

Hard to start developments when newly completed and desirable ones are sitting without buyers.

My understanding is the first tower is basically sold out and the second tower is a decent way through sales, but yea, I suspect sales have plummeted.

The third tower is likely not going to be launched any time soon as a result, but I don't see why they wouldn't start on the first two towers.

Ultimately they said they would start in March originally, it's still the middle of March. They aren't even officially late yet, and construction starts are almost always a bit later than developers hope as the last few steps of getting permits usually takes a bit longer than they expect.

The OLT appeal may or may not be impacting it as well. It's hard to know without knowing what they are actually appealing.

You would think that they have so much money invested already that it's unlikely to stall out now. Two towers basically sold out, presumably contracts signed with suppliers and builders. I think they're just waiting on the crane for 1 Jarvis to free up. and ya, as mentioned, this isn't even late...

I feel like Hamilton is a very different market. The demand is just so much higher there. I think development would be more susceptible to stalling out in Hamilton that Toronto.
