Owner of San Antonio's Hotel Emma sues developer over Austin apartment project's name

Some 80 miles separate San Antonio’s Hotel Emma from The Emma apartments under construction in Austin — too close for comfort for the hotel’s owner.

Rio Perla Properties, owner of the Pearl complex that’s home to Hotel Emma, says in a newly filed trademark infringement lawsuit that the apartment project bearing “The Emma” name creates a “likelihood of confusion” between the two properties.

So Rio Perla wants Austin developer Cumby Group to remove the name from the apartments.

Yeah, I can see how this could be confusing...booking a hotel room in San Antonio and ending up at a construction site in Austin. GPS be damned. This is sooooo petty.

Seems like they have a history of being petty with naming disputes. That being said, if it were in San Antonio, it would make sense. I don't think folks will confuse two properties in two different cities...even if they are *only* 80 miles apart.

Ah well. We're a country built on and propelled forward (backward?) by litigation and pettiness, so I guess it makes sense.

Does anyone know what happened to Jdawgboy? He hasn't posted in over 9 months. He was such an enthusiastic supporter for most anything downtown Austin related, but he seems to have stopped posting.

He told me he was leaving the forum out of frustration about some comments being posted at the time. I don't blame him. Same reason I scaled back my posts. Hopefully he will be back, but he didn't say he would be. I do miss him. He was a constant fixture here. I know him personally and he's a really nice guy.

Or maybe the "real world" is unpleasant enough that it makes no sense to put up with a lot of unpleasantness on SSP.

That someone would find a heavily moderated forum where any personal insults, or other inappropriate behavior would lead to posts being removed, bannings, etc. is still just too much to handle?

I like ABJ's Crane Watch tool but they do a terrible job at keeping it updated. I'm sure they could outsource it to this forum and it would be done for free

A fellow forumer showed me the posts asking about me so I wanted to chime in and say hello and that I am doing well. It's been an interesting year to say the least and we still have a couple more months to go.
