Supreme Court of Canada clears way for developer's lawsuit against HRM

Putting this here as I'm unsure of the best location for this thread, mods feel free to relocate.

HRM just lost (at significant cost to taxpayers no doubt) a case at the Supreme Court of Canada regarding Annapolis Group and the Blue Mountain-Birch Cove Lakes area, which they refused to allow to be developed.

Council's decision was bad at the time and looks even worse now.

The Herald has a story on it as well with additional info:

Wow, this could be a game changer for growth. It's much closer to the core and would be far easier to get proper mass transit up and running to.

Why does it look worse?

Let's not get hasty here. Annapolis has a long hill to climb to win this case. All it's won is the right to a trial, to try to prove its case.

The SCC decision says absolutely nothing about the merits of Annapolis's position or whether HRM council acted wrongly. It had nothing to do with that.
