What FAR then will the builders actually use, then? Not exactly up to speed on that kind of detail here.

Because they are combining lots, the actual planned FAR is around 11.7 for the entire site. But considering just the Hyatt site, the Midtown East zoning has an as-of-right FAR of 27 (through air rights transfers and payments). It also allows for 2 separate special permits that give a bonus FAR of 3 for each:







But the developers are only seeking to use a portion of one of those permits, leaving 352,392 sf of floor space on the floor. The community board and borough president want to make sure they can’t use that additional floor space.
