It doesn't count as a spire by all known definitions. Only CTBUH recognizes it because they caved to 911 sentimentality and decided to ignore their own criteria for what counts as a spire; I.e., it has to be architectural. The garbage pointy thing is still lacking its architectural cladding (except for the very tip) and is therefore ineligible.

Sears Tower is still tallest in the US until CPT takes over.
