I guess they didn't care and just went ahead with building the additional floors, or it was a major oversight.
I noticed that, and wondered whether they would get away with it. Does that mean they have to stop the residential tower as well, or can they keep going and get back to the hotel when/ if the DP is issued. (Presumably they couldn't have a Building Permit for those floors of the hotel until a DP is issued).

Not an oversight I would wager - lack of care is more likely. It was always a huge risk trying to amend the DP/BP in such a major way after construction started, and it just caught up to them and they hedged their bets that the City would let it go (lol).

Some development companies are just run by MBA cowboys who refuse to accept that the philosophy of "it's better to ask forgiveness than permission" is an idiotic way to do business with government officials.

In the picture I saw the order seems to be for the east tower only so they should be able to continue with the residential tower.

Thanks. Not such a big deal for them then, but they'll have to reschedule trades. The hotel also occupies the heritage building underneath the tower, so this shouldn't delay it unless there's some reason for the DP not to be approved. The BP is probably a formality, a the architect has clearly already got the construction designs completed.

I guess they’re pretty confident council just roll over for them.

Council already approved the rezoning earlier this year. It's just the Development Permit that hasn't been issued yet.

The development permit changed to "Approved Subject to Conditions" but hasn't been issued yet.
