Burlington settles for 12-storey towers and 9-storey building at former mall site

It's been years in the making but there is now agreement.

Burlington city council voted in favour on Aug. 24 of accepting an offer for a revised development concept at 5111 New Street — the former Appleby Mall. ​The revised development concept proposes 368 dwelling units in both apartment and townhouse forms ​in one nine-storey and two 12-storey buildings. ​

The development proposal originally included a 17-storey building and resulted in widespread opposition from neighbours. ​...

The decision will settle the issues in dispute between First Capital (Appleby) Corporation and the city with respect to First Capital’s appeal currently before the Local Planning Appeal Tribunal.

‘We have the answer’: Major residential development coming to Burlington plaza and here are the details

It’s been in the works for a long time.

The Ontario Land Tribunal (OLT) recently released its decision for the development at 5111 New St. — Appleby Mall. The decision will permit the developer to construct three multi-unit residential buildings, one nine stories tall and two 12 stories tall, at the Appleby Village Plaza at Appleby Line and New Street.

Back in 2020, the OLT had approved a settlement between the city and the developer, but had withheld its order confirming the approval of the settlement while the two parties provided the Official Plan amendments and zoning bylaw amendment in their final forms.

Ward 5 Councillor Paul Sharman said the decision brings long-awaited answers to the community.

“Since 2014, the community has been waiting for information about what is going to be built on the parking lot on the north side of the Fortinos at Appleby Village, today we have the answer, and this settlement brings certainty to residents. Of special importance will be the welcome inclusion of a retirement home, which may provide a ‘close to home’ residence for older members of the neighbourhood who are ready to sell their house,” said Sharman.

During the time between the 2020 approval and this year, the developer changed the concept for the project to include a retirement home use. In September 2022, Burlington city council approved an amendment to the Offer to Settle to include “retirement home” as a permitted use.

Mayor Marianne Meed Ward thanked residents, the developer and city staff for working together to shape the project.

“This development will bring a variety of needed housing units right beside shops and services. It is the future we see for our aging retail plazas in Burlington and one more way to accommodate and welcome our share of new residents as Burlington continues to grow,” said Meed Ward.
