Brooklyn’s 80 Flatbush will rise after settlement reached in lawsuit

After months of legal sparring, the developer behind a planned mixed-use project due to rise at 80 Flatbush Avenue has settled a lawsuit brought by neighbors seeking to stymie the project.

Alloy Development and members of the 400 & 500 State Street Block Association have reached a settlement that puts the homeowner’s Manhattan Supreme Court case to bed, allowing the project to press forward. The decision came almost exactly a year after the City Council approved plans for the development—which will have two towers, topping out at 840 and 510 feet—to rise, according to a September 13 letter to Supreme Court Judge Melissa A. Crane from David Paget, an attorney who represented Alloy during the case.

“We write on behalf of all parties ... to advise the Court that Petitioners and Respondent 80 Flatbush Avenue LLC have reached a settlement that fully resolves the dispute,” wrote Paget. “All parties have agreed to discontinue the above-referenced action.”

In a community benefits agreement obtained by Curbed, Alloy agreed to several stipulations, including conducting real-time air quality monitoring for construction dust throughout the project; crafting and implementing noise minimization measures during work; and sharing foundation plans and reports on geotechnical test performed at the site once the Department of Buildings issues permits for the project, among other arrangements, the agreement shows.

“We’re pleased to honor our commitment to establish a Community Benefits Agreement with our neighbors,” an Alloy spokesperson confirmed to Curbed. “Demolition on site is underway, we look forward to starting vertical construction next spring, and to ultimately following through on our promise to deliver 200 units of permanently affordable housing and two new public schools in Downtown Brooklyn.”

Alloy plans to erect the development on the edge of Downtown Brooklyn and Boerum Hill, on a site bounded by Flatbush and Third avenues, and State and Schermerhorn streets. It will have 900 apartments, 200 of which would be permanently affordable, along with office and retail space. The project initially called for one of the two new towers to rise to a staggering 986 feet, with the other structure reaching a comparatively modest 560 feet. But after fierce pushback and much back-and-forth, the City Council approved a plan that kept most of the buildings’ density, along with the 200 affordable units, while scaling back the height.

Demolition At 80 Flatbush Avenue Nears Completion In Boerum Hill, Brooklyn

Demolition is underway to clear the site for the construction of a multi-structure development that will include one of the borough’s tallest skyscrapers. A large assembly of scaffolding and black netting shrouds what remains of the original brick structure that is being dismantled floor by floor. Last year the City Council approved the project, which had a reduction in size and scale and a redesign of the largest tower. Alloy Development is the developer of the complex, which is located on a triangular plot bound by Flatbush Avenue, State Street, Third Avenue, and a small sliver of Schermerhorn Street.

All the demolition is occurring on the southern end of the site with a two-, three-, and five-story building squeezed into the tight end of the parcel.

The development includes the preservation of two historic structures, a planned 350-seat elementary and high school by Khalil Gibran International Academy, and two ground-up skyscrapers. The tallest of these got a height cut from the proposed 986 feet to a range between 825 feet to 845 feet high. This also resulted in the scaling back of the floor area ratio from 18 to 15.75, and a total of 870 residential units instead of 900. The number of affordable homes for 80 Flatbush Avenue has fortunately remained the same at 200.

A start and completion date for the new 80 Flatbush Avenue complex has not been announced yet. Demolition and clean up of the narrow triangular site should likely wrap up before the end of the year.

The closest subways are the 2, 3, 4, and 5 trains at the Nevins Street station up Flatbush Avenue and the B, D, N, Q, and R trains at the Atlantic Avenue-Barclays Station. The Atlantic Terminal is across the street to the south.

Construction and completion dates for the skyscraper has not been announced yet.

Demolition Wraps For Future Skyscrapers At 80 And 100 Flatbush Avenue In Boerum Hill, Brooklyn

Questions remain about when the affordable housing component of the project, its main selling piece, will be fully delivered, whether there are any meaningful penalties associated with ensuring timely delivery, and what they may be.

Alloy Development proposed the project as a mix of market-rate and affordable rentals, office space as well as two new schools, and cultural space on a trapezoidal site bounded by Flatbush and Third avenues, and Schermerhorn and State streets.

The project was to be developed in two phases. The first phase would contain a flatiron-shaped tower at Flatbush Avenue and State Street, home to market-rate units and office space, as well as the schools. Phase two would involve a larger tower extending from a more cubic base, stretching some 840 feet, which would contain market-rate and affordable housing units.

Walked by the site today. Looks like they're finally ready to start Phase 1 construction. Lots of site prep activity going on now, after lying dormant for over a year.











Bonus 7 DeKalb, soon to be blocked by the construction walkway.
