In Germany, you will be pulled over, and your car seized, if you're driving too fast/recklessly in a "no speed limits" zone. It isn't a free-for-all. It's putting the onus on the driver to behave in a responsible manner, given road conditions and traffic.

Then maybe adaptive speed limits would be better. Having it up to the officer's discretion is inviting all sorts of potentially unfair enforcement. This is why all traffic laws should be strictly enforced as well.
