Well that's an unfortunate mess. Seems like one of those cases where the legalities make this way more complicated than it "needs" to be.
Normally extension of commencement would be a simple non-substantive amendment to the development agreement. But the development agreement has lapsed because they missed the commencement day (apparently due to contaminated soils), and they can't "un-lapse" it because the policy that allowed the development agreement got deleted when Centre Plan came into effect.
Weird thing is that they did an amendment to the agreement in 2017 but didn't ask for a time extension.
