Some 80 miles separate San Antonio’s Hotel Emma from The Emma apartments under construction in Austin — too close for comfort for the hotel’s owner.
Rio Perla Properties, owner of the Pearl complex that’s home to Hotel Emma, says in a newly filed trademark infringement lawsuit that the apartment project bearing “The Emma” name creates a “likelihood of confusion” between the two properties.
So Rio Perla wants Austin developer Cumby Group to remove the name from the apartments.
