The city would still have to have an agreement with CN to go over their mainlane so the same legal access problem with the delay may have occured.
I also sort of think that Russ W is not dealing with CN. Its going to be between the Winnipeg city legal department and CN's legal department.
If anything the city legal and material management (aka purchasing) departments should be getting their fingers rapped for having the contractors start before all the legal work was done.
