Wow, that sucks. This is clearly because CBYE is complaining to them about it - probably throwing the word "libel" around and stuff. I can understand the spec not wanting to risk being sued as I believe it's possible to be held accountable for other peoples' comments on a website that you control.

This stupid precedent muffles open discussion and free speech. Perhaps the spec should set up their comments engine to be hosted in a different country haha

Downtown architects working on Tivoli tower design

The new owner of the Tivoli Theatre has contracted Hamilton architects McCallum Sather to design a combined commercial, residential and performance space in the long-neglected building on James Street North.

McCallum Sather architect Drew Hauser told YourHamiltonBiz that the theatre will remain in the building, which will also see a condo component. He would not go into detail on what the building would look like.

McCallum Sather has a focus on “adaptive re-use” of buildings and energy efficiency, with previous work including the interiors of Hamilton City Hall, the Dundas Museum and Archives and McMaster University’s Phoenix Pub.

According to individuals familiar with the plan it includes a residential tower and “lots of glass.”

One said it was about 12-storeys and “very sexy,” while another said it looked “very nice.”

Local architect Bill Curran, who has part ownership of the building adjacent to the Tivoli, said the property would require rezoning in order to accommodate such a project.

He hadn’t seen the drawings, but said the site is currently designated for a 22-metre building, which would be approximately seven storeys.

“If they had applied for rezoning, there would be a sign on the property and I haven’t seen one,” he said, adding such a measure would also require a public meeting.

“The Tivoli is a fabulous community asset and it’s sitting there rotting.”

City spokesperson Debbie Spence said no planning application has been submitted for the Tivoli.

Hauser said they would begin the process in the coming weeks.

At first I'm thinking 12 stories is gonna look awkward in that part of James North but if the lobby of the theatre acts as a bit of a podium, it will probably look pretty decent.

Twelve stories will cause a bit of an uproar on James North if the Acclamation project is any indication. But yes, if there's a strong podium that fits in scale-wise with the street then few will even notice it's 12 stories.

It would be great if both the Tivoli site and the adjacent property (Centre Pointe strip mall) could both be developed in tandem, though not necessarily as one large project.

Now all the Nimby's will come out of their holes to oppose the project. In this city a few big mouths can cause alot of problems for developers. Thats why we don't get nice things in this city and end up with ugly compromise buildings in the downtown.

There are a lot of reasons why we can't have nice things. I'm not sure NIMBYism even registers on that list, however.

I was wondering around downtown this morning and noticed a drilling company drilling in the alley beside the Tivoli Theater. I was going to ask one of the workers what they were drilling for but he didn't look to friendly.

Okay, I am a bit of an idiot, and have only recently been getting into downton Hamilton architecture/buildings, but isn't the Tivoli Theatre GONE? I thought it collapsed in on itself about 10-15 years ago and now its just an empty lot beside the CBC office? But then I see things like Steeltown saying "theatre will remain" and Curran "The Tivoli is a fabulous community asset and it’s sitting there rotting". What am I missing?
