Day 1 of 3 days of hearings about Capital Pointe started this morning. Westgate is fighting the fill-the-hole order.

The Saskatchewan Building and Accessibility Standards Appeal Board will hear the dispute between the City of Regina and Westgate Properties Ltd., the developer of the Capital Pointe project today. I'll have updates throughout the day.

The speaker for the appeal board opens by saying the board has the power to confirm the order, revoke the order, or vary the order issued by city in regards the the Capital Pointe property.

Lawyer for Westgate Neil Abbott says he disputes the city's claim that the site isn't safe.

Abbott wants order to backfill revoked, but says if board does find in favour of the city, they want the order to backfill to be modified to find another solution. #yqr #capitalpointe

Abbott says today's hearing should only focus on the order to comply, ie the safety of the site, and not other concerns that have been raised about the project. #yqr #capitalpointe

his article makes me believe that the appeal might be denied, but we don't really know. So I guess the end of August. "Time keeps ticking in my head..."

Appeal board gives Capital Pointe 3 options for hole

The fate of Capital Pointe now lies with the development company itself as the appeal board has given it three options and a deadline to decide what to do in a month.

The Saskatchewan Building and Accessibility Standards (SBAS) released its decision on the appeal on Friday at noon. Instead of upholding the City of Regina’s Order to Comply to backfill the hole issued on April 3, 2018, the SBAS varied the order by giving Westgate Properties three options and a deadline of September 30 to tell the city.

So:

1 - start building by April 1st, 2019 with building permits submitted by Februrary 28th, 2019 and actually have it completed by March 2020.
2 - add permanent shoring to the hole
3 - backfill it as the city said, starting no later than November 30, 2018.

So what is stopping them from just saying option 1 and continuing to do what they are doing? There is no specific penalty stated for failing to comply that I saw. did I miss it? Doesn't seem like what you guys wanted which sucks.

There are some things they have to have done as early as Oct 31, 2018.

And when they don't recommence work by Dec. 8th? Any clearly defined repercussions?
