Do any of our foreign buyer or speculation taxes go against Section 11 of NAFTA?

Saw this mentioned and I was wondering. Does look like it goes against it. I know a NAFTA lawyer says the foreign buyers tax does in one article. He said it also goes against many of our trade treaties.
