North Canada Oils / Capital Pointe are another exception to the rule. Because the NCO building has a blank facade on the west side, Capital Pointe was allowed to build their building right up to the property line with a matching blank facade until their building exceeds the height of the NCO building. If the NCO had had windows on the western facade then a 20m tower separation would have been mandated. Council always has the discretion to make an exception, but currently the requirement is a 20m separation.
One of the impacts of having the two towers but up against each other is that should Capital Pointe be built, then the NCO building site will be unable to accommodate more development than is currently there. I wonder if the developers of CP purchased some air rights from NCO to preserve their future tenant's views in perpetuity
