I don't think the issue was that the top portion isn't strong enough, the concern was more about building sway on the upper floors. The sheer walls are load bearing so I'm not sure what effect it could have had on sway to run them the height of the building, but I'm not an engineer.

Assuming it would have alleviated the problem, it does beg the question of which option would have been more expensive. Cost overrun in additional material costs to run the sheer walls to the top VS. the cost overrun they incurred with the late stage redesign of those floors.
